CORAM:
HON'BLE MR. JUSTICE SURESH KUMAR KAIT
O R D E R
% 14.10.2019 CRL.M.A. 37177/2019 I find no ground to interfere with the order dated 20.09.2019. The application is, accordingly, dismissed.
CRL.REV.P. 900/2019 After hearing arguments from both the parties, I am of the opinion that no order is required to be passed in the present petition and the petitioner shall continue to pay maintenance of ₹15,000/- per month pursuant to order dated 20.09.2019 till final decision of the Ld. Trial Court in Domestic Violence Petition.
Further, the Ld. Trial Court is directed to take final decision on the said case within four months from the next date of hearing fixed before it. It is hereby made clear that the petitioner shall clear the arrears of
maintenance of ₹15,000/- per month within three months from today. I hereby made clear that the direction regarding the maintenance passed by this Court shall be without prejudice to right and contentions of the parties and the Ld. Trial Court shall take final view keeping in view the submissions of the parties.
The present petition is, accordingly, disposed of. It is pertinent to mention here that after disposal of the present petition, counsel for the petitioner insisted this Court to pass an order in favour of the petitioner and not allowed the Court to take up another matter. Thus, she has wasted the previous time of this Court. Accordingly, I hereby impose cost of Rs.10,000/- to be deposited in favour of Nirmal Chhaya, Jail Road, Hari Nagar, New Delhi for destitute women and children within two weeks from today, failing which, the Registrar General shall ensure the recovery of the cost amount as per law. The date already fixed in the matter i.e. 27.11.2019 stands cancelled. SURESH KUMAR KAIT, J OCTOBER 14, 2019 ms
