% 08.08.2024 CM APPL. 45445/2024 (filed by the petitioners seeking extension of interim order dated 29.07.2024) 1.

Vide order dated 29.07.2024, the Court declined to entertain the instant writ petition and the stay was extended for a period of 10 days from the date of passing of the order to approach the jurisdictional High Court. 2.

Learned counsel appearing for the petitioners/ applicants submits that as per his instructions, the Member (law) in Central Electricity Regulatory Commission ["CERC"] has been appointed and the CERC is likely to resume its functioning within a day or two. This Court is of the concerned opinion that once the writ petition was declined to be entertained on the issue of jurisdiction, there is no reason to further extend the time. The petitioners had enough time to approach the jurisdictional High Court after 29.07.2024.

In view of the aforesaid, the Court is not inclined to extend the time and the application stands dismissed.
