A Writ Petition under Article 226 of the Constitution of India read with Section 482 Cr.P.C has been filed for quashing of FIR No.0114/2023 dated 21.06.2023 registered under Section 308/34 IPC at Jafarpur Kalan. 2.

The complaint respondent No. 2 gave a statement to the Investigation Officer that on 20.06.2023 he along with his friend Himanshu respondent No.3 had gone to village Ishapur, New Delhi and at about 01:30A.M. they had gone to take meals at Dhansa. It is submitted that all the petitioners and respondent No. 2 and 3 have already sorted out their all differences with the intervention of their respective persons of the vicinity and they have left no grudge or grievance against each other in any manner whatsoever. Therefore, the Petition be quashed.

Learned Prosecutor submits that petitioner No.1 is also involved in FIR No.374/2017 under Section 302/307/34 IPC and 25/27 Arms Act and also in FIR No.38/2018 under Section 186/353/307/34 IPC and 25/27 Arms Act.

The complainant respondent No.2 is present in the Court and submits that they had a scuffle with each other and now the matter stands settled with all the five accused in terms of Memorandum of Understanding dated 29.09.2023. It is also submitted that after the registration of the FIR there is no enmity between them and that the Settlement has been arrived at without any pressure, force or coercion. The parties are present in the Court and endorsed the terms of the Settlement and undertake to abide by the terms of the Settlement dated 29.09.2023. The respondent No2 and 3 have no objection if the FIR is quashed against the petitioners on account of the settlement already arrived at between the parties. 6.

In view of the submissions made, the Petition is allowed.
