Status report along with reply from the Holy Family Hospital Delhi filed.

Learned counsel for the petitioner submitted that the revised date for operation of the husband of the petitioner is now fixed for 5.9.2019.

The Trial Court, vide order dated 8.8.2019, has passed the following order:

"7. Keeping in view all these facts, a custody parole for four days i.e. 9.8.2019 to 12.8.2019 is granted to the accused with a direction to the Superintendent, Jail to take the accused to Holy Family Hospital who will stay there from 10:00 am till 6:00 pm one each day and thereafter, she will be brought back to the jail. Superintendent, Jail shall depute sufficient security in civil dress." 4.

Learned APP submitted that the petitioner is having a

son, aged 17 years, who can take care of the husband of the petitioner, however, he does not oppose the grant of custody parole to the petitioner for two days.

Taking into consideration the status report, reply from the Holy Family Hospital, the order of the Trial Court as well as the nature and gravity of the offence, I deem it appropriate to pass the similar order for the grant of four days custody parole to the petitioner from 5.9.2019 to 8.9.2019, with a direction to the Superintendent, Jail that the petitioner will be taken to the Holy Family Hospital and should be allowed to stay there from 10:00 am to 7:00 pm each day and thereafter shall be brought back to the jail. Superintendent, Jail is also directed that the police official(s), who will accompany the petitioner, would be in civil dress.

Bail application is disposed of in above terms. 7.

A copy of this order be sent to the Superintendent, Jail. Dasti.
