The plaintiff has instituted the present suit against her son, daughter-in-law and grandson (defendants herein) for possession, declaration and permanent injunction etc.

Counsel for the plaintiff states that during the pendency of the present proceedings, the parties have arrived at an out of court settlement in respect of the suit premises bearing No.WZ-174, Plot No.382, Khasra No.35/9 and 12, Village Khayal Colony, Chand Nagar, New Delhi, in terms of the Settlement Agreement dated 12.05.2015. 3.

Counsel for the plaintiff states that an out of court settlement was arrived at not only between the plaintiff and the defendant No.1 herein, but also with her other two sons, namely, Mr. Ranjit Singh and CS(OS) 729/2012 Page 1 of 3

Mr. Jaswant Singh, who are also present in Court today and have been identified by the plaintiff and the defendant No.1. 4.

Learned counsel for the plaintiff submits that the terms and conditions of the Settlement Agreement deal with the suit property mentioned hereinabove, apart from a shop bearing No.A-5 (Shop No.3), comprised in Khasra No.1635, situated in the Abadi of Colony Manak Vihar Extension, Opposite Pocket No.2, Subhash Nagar, New Delhi and a residential premises No.G-4, Vishnu Garden, New Delhi. In terms of the settlement, the plaintiff has given up her all rights, title and interest in the suit premises in favour of the defendant No.1 and the defendant No.1 has executed a registered Relinquishment Deed in respect of Shop No.A-5 referred to herein above, in favour of his younger brother, Mr. Ranjit Singh. Further, the defendant No.1 has agreed to give up all his rights, title and interest in the residential premises No.G-4, Vishnu Garden, New Delhi. Mr. Ranjit Singh and Mr. Jawant Singh, who are sons of the plaintiff and brothers of the defendant No.1 state that they shall remain bound by the settlement recorded in the Settlement Agreement.

In view of the fact that the plaintiff and the defendant No.1 state that they have arrived at a family settlement, that has been reduced into writing by virtue of the Settlement Agreement dated 12.05.2015, CS(OS) 729/2012 Page 2 of 3

the same is taken on record. The parties shall remain bound by the said settlement. The suit is decreed in terms of the family settlement, recorded in the Settlement Agreement dated 12.5.2015, while binding all the parties thereto.
