The present petition has been preferred by the petitioner being aggrieved by the order dated 19.03.2025 passed by the Central Information Commission (CIC) in Second Appeal No. CIC/PASBK/A/2024/612141 (hereinafter referred to as 'the second appeal'). 4.

The petitioner contends that vide the aforementioned impugned order dated 19.03.2025, the CIC declined to entertain the second appeal of the petitioner (on merits) on the basis that the W.P.(C) 9837/2024 preferred by the petitioner is pending before this Court wherein the petitioner has challenged the decision concerning the subject matter of the second appeal. 5.

However, it is submitted by the petitioner that the said W.P.(C) 9837/2024 is with regard to a completely unrelated RTI Application, having no bearing on the RTI Application which is the subject matter of the present The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. As such, there was no occasion for the CIC to refrain from deciding the second appeal of the petitioner on the ground of pendency of the said W.P.(C) 9837/2024.

A perusal of the order dated 19.07.2024 passed by this Court in W.P.(C) 9837/2024 substantiates that the said proceedings are in the context of a different RTI application. Moreover, no interim order has been passed in W.P.(C) 9837/2024, staying the operation of the CIC order in that case. In the circumstances, it would be apposite for the CIC to decide the second appeal on merits.

In the aforesaid circumstances, the impugned order dated 19.03.2025 is set aside. The matter is remanded back to CIC for deciding the second appeal of the petitioner on merits. Let the same be done by the CIC as expeditiously as possible.

The present petition stands disposed of in the above terms. 10.

Needless to say, in the event of the petitioner being aggrieved by the outcome of the second appeal, he shall be at liberty to avail appropriate remedies under law.
