This is a petition seeking appointment of a Sole Arbitrator for adjudication upon the claims of petitioner-company against the respondent.

It is stated by Mr. Siddharth, learned counsel for the respondent that the CIRP proceedings are still pending against the respondent-company and hence, the present petition will not lie in view of the moratorium imposed vide Section 14 of the Insolvency and Bankruptcy Code, 2016. 3.

Taking the statement of Mr. Siddharth, learned counsel on record, the present petition is disposed of granting liberty to the petitioner to revive the petition once the moratorium is lifted.

In addition, the petitioner shall also be at liberty to approach the IRP appointed for the respondent-company.

The petition is disposed of with liberty as aforesaid.
