The present petition under Article 226 of the Constitution of India, 1950 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeks grant of furlough for a period of three weeks. 2.

The Applicant is a convict serving life sentence in FIR No. 72/2011, under Sections 302/392/397/411/120B/34 of the Indian Penal Code, 18601, registered at P.S. Vivek Vihar.

On an earlier occasion, when the Petitioner's application for furlough was declined, he had filed a petition [WP (Crl.) No. 1463/2025], wherein this Court, by order dated 5th May, 2025, directed the competent authority to 1 "IPC"

decide the Petitioner's application within 10 days. 4.

Aggrieved by the fact that no decision had been rendered on the application, the instant petition was filed. Mr. Sanjay Lao, Standing Counsel for the State, informs the Court about order dated 26th May, 2025 rejecting Petitioner's application. A copy of the said order has been provided to counsel for the Petitioner and the same is also taken on record. 5.

In light of the foregoing, counsel for the Petitioner seeks leave to withdraw the present petition, with liberty to challenge the order dated 26th May, 2025.

Leave and liberty granted. Petitioner's challenge to the order dated 26th May, 2025, shall be considered on its own merits, in accordance with law. All rights and contentions of the parties are left open. 7.

Dismissed as withdrawn with liberty as aforesaid. The pending application is also disposed of.
