A Writ Petition under Section 482 Cr.P.C. has been filed on behalf of the Petitioner for quashing of FIR No.0010/2017 under Section 420 IPC registered at Police Station Tughlak Road.

It is argued on behalf of the Petitioner that the FIR needs to be quashed as the dispute involed is essentially commercial in nature and the allegations made in the FIR do not even make out a prima facie case under Sectioin 420 IPC. Moreover, the Respondent had taken some cheques from the Petitioner on which no investigations have been done till date. 3.

Learned ASC for the State submits that the Chargesheet has been filed in the year 2022, but the arguments are pending at the stage of framing of Charge. It is further submitted that all these grounds which have been taken in the FIR can very well be taken at the time of arguments on Charge or any other stage in accordance with law and the present Petition is liable to be The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Essentially, it is on the merits of the case that the FIR has been challenged. After due investigations, the Chargesheet stands filed. The grounds which are agitated herein are subject matter of arguments on Charge.

Considering the circumstances that the Chargesheet has been filed and the right being available with the Petitioners to raise these contentions at the stage of arguments on Charge, nothing more survives in the present Petition, which is hereby disposed of with liberty to the Petitioner to raise all these contentioins before the learned Trial Court in accordance with law. 8.

The Petition stands disposed of accordingly.
