The subject matter of the present petition is a health insurance policy purchased by the Petitioner from the predecessor of Respondent No. 1. 2.
The Petitioner and Respondent No. 1 have now entered into a compromise where they have agreed on the following terms: "2. That the petitioner and respondent No.1 have entered a compromise whereby the respondent No.1 has agreed to:
a. Renew the Mediclaim policy from 21.02.2024 for a period of one year and thereafter upon payment of requisite premium by the petitioner covering all Pre-existing diseases.
b. Pay a sum of Rs. 65,720.00 towards post hospitalization charges in regard to claim of lump on thigh.

c. Pay a sum of Rs. 1,45,332.00 towards the eye surgery got done during the pendency of the present writ petition.
3. That the petitioner has no objection to the same and is willing to pay the premium for renewal of health policy covering him and his wife as and when the same is renewed."

Counsel for the parties request that the present writ petition be disposed of with a direction that parties shall abide by the terms of the compromise.

Accordingly, the application is allowed and the present writ petition is disposed of. It is made clear that parties shall remain bound by the terms of the compromise. It is further agreed between the parties that Respondent No. 1 will intimate the amount of the premium for renewing the Mediclaim policy to the Petitioner, within four weeks from today. The Petitioner shall make payment of the said premium within one week thereafter. Further, Respondent No. 1 has assured that they shall make the payments in terms of paragraph Nos. 2(b) and 2(c), within four weeks from today. 5.
Accordingly, the application is allowed and the present writ petition is disposed of, with the above directions.
