This petition has been filed seeking parole for the petitioner who has been sentenced for a period of 12 years, in FIR no. 936/2014 registered at PS Okhla, under Sections 342 IPC & s.6 POCSO.

The Criminal Appeal No. 482/2020, challenging the conviction order was dismissed by this Court on 11th October, 2023. 3.

Petitioner has applied for parole, however, there has been no response from the Competent Authority. An application was made on 29th April, 2024. 4.

As per the Nominal Roll, the Jail conduct is satisfactory; interim bail was granted in 2021 for two weeks by this Court, and furlough in 2024 for three weeks, by the DG Prisons, and the liberty has not been misused. 5.

The period undergone is about 7 years including remission. The parole is sought for filing of SLP before the Supreme Court. 6.

In view of the above, this Court sees no impediment in granting parole to the petitioner. The petitioner is enlarged on parole for a period of four weeks from the date of release, subject to furnishing a personal bond in the sum of Rs. 10,000/- (Rupees Ten Thousand only), with one surety of the like amount to the satisfaction of the Jail Superintendent subject to the following conditions:- i.

During the period, petitioner remains out on parole, petitioner shall report to the SHO, Police Station- Okhla, Delhi on every Saturday at 4pm, and shall not be kept waiting for more than an hour. ii.

Petitioner shall also provide the SHO, Police Station- Okhla, Delhi with mobile telephone number which shall be kept in working condition at all times and shall not switch off or change the mobile number without prior intimation to the SHO concerned.

iii.

Petitioner shall not leave the National Capital Territory of Delhi, during the period of parole, without the prior permission of this Court. iv.

Petitioner shall not indulge in any criminal activity, and shall not communicate with or come in contact with the complainant/victim, or any member of the complainant/victim's family. v.

Petitioner is directed to surrender before the jail authorities at the expiry of the period of parole.

Accordingly, the petition is disposed of.

Copy of the order be sent to the Jail Superintendent for information and necessary compliance.
