By way of the present petition filed under Article 226 of the Constitution of India, the petitioner is aggrieved by the dismissal of her complaint before the Labour Commissioner whereby the Petitioner sought the relief of gratuity on the ground that the petitioner has challenged her termination, which is being adjudicated separately. 2.
Notably, Section 7(7) of the Payment of Gratuity Act, 1972, read with Rule 18 of the Payment of Gratuity (Central) Rules, 1972, provides for appeal against the order passed by the competent authority under the said act. Accordingly, the present petition is disposed of with liberty to the petitioner to approach the Appellate Authority at the first instance. 3.
Needless to state that the Appellate Authority will decide the matter on merits in accordance with law.
