BAIL APPLN. 2162/2019 Vide the present petition, petitioner seeks interim bail for a period of one month from the date his release from jail in case FIR No. 126/18, registered at PS - Bada Hindu Rao for the offences punishable under Sections 328/367/377/506/34 IPC, 6 POCSO Act & 67 I.T. Act. The present petition is filed on the ground that his father is hospitalised and presence of the petitioner is required to take care of his father.

Learned counsel for the petitioner submits that the petitioner has earlier been granted interim bail and he surrendered after expiry of the bail period.

For the aforesaid purpose, the petitioner moved an application before the learned trial Court. Same has been dismissed on the ground that there is no immediate need of the petitioner to be with his father as surgery has already taken place. Moreover, there are other children of father of the petitioner who can take care of him.

Learned APP for State has verified the factum of the medical documents of his father and submits that the petitioner has not violated the terms and conditions of the interim bail earlier granted to the petitioner. Keeping in view the fact that the father of the petitioner was hospitalised and is seriously ill, on the humanitarian ground, I hereby grant the petitioner four weeks' interim bail from the date of his release. The trial Court is directed to release the petitioner on the same terms and conditions as were imposed earlier when the petitioner was released earlier by the trial Court.

The petition is accordingly allowed and disposed of with the aforesaid directions.

Copy of this order be given dasti under the signatures of Court Master.
