The present writ petition has been filed on account of Show Cause Notice dated 2nd April, 2025, issued by the respondent-Municipal Corporation of Delhi ("MCD"), to the petitioner vide which the respondent has asked the petitioner to show cause as to why the tender/contract in respect of 'Parking Site 3Cs, Feroz Gandhi Road, Veer Savarkar Marg, Lajpat Nagar; Haldiram's Lajpat Nagar; Central Market', should not be cancelled for non-compliance of the terms and conditions of the Notice Inviting Tender ("NIT").

petitioner was constrained to file a writ petition earlier also, i.e., W.P.(C) 16671/2024, titled Lakhvinder Singh Versus Municipal Corporation of Delhi. He submits that vide order dated 3rd December, 2024, it was categorically recorded that the representations of the petitioner, with regard to the various difficulties being faced by him in running the parking site, shall be considered by the MCD.

Learned Senior Counsel appearing for the petitioner submits that despite the aforesaid undertaking, as noted in the order dated 3rd December, 2024, in the previous litigation between the parties, the earlier representations of the petitioner, have still not been decided. 4.
Learned Senior Counsel for the petitioner further submits that instead of deciding the earlier representations of the petitioner, a fresh Show Cause Notice dated 2nd April, 2025, has been issued to the petitioner. It is submitted that the petitioner has already filed a reply dated 4th April, 2025, to the said Show Cause Notice. However, the decision in regard thereto, is still awaited.

Thus, the present writ petition has been filed challenging the various actions of the respondent - MCD.

Issue notice. Notice is accepted by learned counsel appearing for respondent - MCD.

Learned counsel appearing for the MCD submits that there have been complaints against the petitioner for overcharging. He further submits that the petitioner is paying only 50% of the Monthly License Fees ("MLF"), which is due and payable by the petitioner.

He, however, submits that the MCD shall consider all the representations of the petitioner which have been submitted earlier, as well The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

At this stage, learned Senior Counsel appearing for the petitioner disputes the fact that only 50% of the license fee is being paid by the petitioner.

Without going into the aforesaid issue, in light of the submissions made before this Court, it is directed that the MCD shall consider the various representations made by the petitioner, as contained in Annexure P-7 to Annexure P-11, of the present petition.

Further, the reply dated 4th April, 2025, submitted by the petitioner to the Show Cause Notice dated 2nd April, 2025, shall also be considered. 12.
At the time of considering the representations of the petitioner, the petitioner shall also be granted opportunity of personal hearing. 13.
Needless to state that at the time of finally deciding the Show Cause Notice dated 2nd April, 2025, the MCD shall also take into consideration the various submissions made by the petitioner in the said representations. 14.
Let the same be done expeditiously, preferably, within a period of three months from today.

In case, the petitioner is aggrieved by any order that may be passed by the respondent-MCD, the petitioner is at liberty to seek his remedies, in accordance with law.
