Learned counsel for the respondents has taken preliminary objection on the maintainability of the present writ petition in view of the Section 7-I of the Employees' Provident Funds And Miscellaneous Provisions Act, 1952 which provides for appeals to the tribunal. 2.

At this stage, learned counsel for the petitioner seeks leave to withdraw the present petition.

Leave, as prayed for, is granted and the petition is dismissed as withdrawn.

Needless to say that this Court has not expressed any opinion on the merits of either of the contentions. The appeal, as and when filed, will be considered in accordance with law.
