Allowed, subject to all just exceptions.

W.P.(CRL) 1835/2025 2.

After part submissions, learned counsel for petitioner seeks permission to withdraw this petition with liberty to file appropriate application before the competent authority.

4.

Accordingly, the petition is dismissed as withdrawn with liberty as sought.

5.

However, it is noticed that the prescription dated 16.05.2025 certifying that the patient needs help for daily activities was issued by one Dr. Ishwar Bohra, described in the prescription as Senior Director, Joint Replacement in BLK Max Hospital. It is quite strange that an orthopaedician is issuing such certificate for a prostate patient. Detailed inquiry into this aspect would cause delay in the relief of parole in case the petitioner truly deserves the same. However, a copy of this order be sent to the Director, BLK Max Hospital through Investigating Officer for information and necessary course correction.

6.

Copy of this order be sent to the Jail Superintendent for compliance. GIRISH KATHPALIA, J MAY 29, 2025 'rs'
