Through the present writ petition, the Petitioner seeks quashing of the FIR No. 546/2023 dated 3rd November, 2023, under Sections 447 and 34 of the Indian Penal Code, 18601 read with Section 3 of the Prevention of Damage to Public Property Act, 1984, Section 26 of the Indian Forest Act, 1927, and Section 8 of the Delhi Preservation of Trees Act, 1994, registered at P.S. Maidan Garhi, New Delhi.

Counsel for the Petitioner submits that he has been falsely implicated in the subject FIR as, firstly, he is not the owner of the property which is the subject matter of the FIR and secondly, as per Minutes of Fourth Meeting of the Oversight Committee of the Department of Forests and Wildlife, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. GNCTD held on 18th February, 2024, the subject land has not been notified as a forest. A copy of the said Minutes of Meetings dated 18th February, 2024, has been handed over across the board and is taken on record. 3.

The Court has heard the contentions raised by counsel for the Petitioner and specifically queried from him as to the stage of investigation, which is stated to be at a nascent stage. Therefore, since the matter is at the stage of investigation, in the opinion of the Court, at the first instance the aforenoted documents ought to be furnished by the Petitioner to the concerned Investigating Officer2, so that they can be properly examined. 4.

Thus, the Petitioner is directed to supply a copy of the Minutes of Meetings dated 18th February, 2024 as well as the ownership documents of the property in question to the concerned IO within 2 days from today. These documents shall then be examined during the course of investigation, in accordance with law.

In the event the investigation in the impugned FIR culminates into any adverse action against the Petitioner, he shall be at liberty to take recourse to appropriate remedies, in accordance with law. 6.

In light of the above, the present petition is disposed of. 7.
