Learned counsel appearing on behalf of the petitioner seeks to withdraw the present petition with liberty to approach the learned Debt Recovery Tribunal ('DRT', for short) under Section 17 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 ('SARFAESI Act', for short).

The petition is dismissed as withdrawn with liberty as aforesaid. Learned DRT may take into account the period spent by the petitioner before this Court by way of the present writ petition while dealing with the aspect of limitation.

In the meanwhile, respondent no.3/Bank is directed not to take any coercive action against the present petitioner for a period of three weeks The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
