The present Appeal under Section 378(4) of the Cr.P.C. has been filed against the Judgment and Order dated 01.07.2019 passed by the learned Metropolitan Magistrate in Complaint under Section 138 of the Negotiable Instruments Act. Bailable warrants were directed to be issued against the Resondent.

As per report received from SHO Police Station Malviya Nagar, ASI Vinod Kumar, had gone to the Prayagraj, Allahabad, UP at the residence of Respondent, where he met Ms. Priyanka, wife of the Respondent, who informed that her husband/ Respondent has died on 17.03.2024. A copy of Death Certificate has been supplied, which is filed along with the Report dated 14.10.2024. This fact was noted in the Order dated 11.12.2024. No steps have been taken thereafter.

Considering that Respondent has died, the present Petition stands abated and accordingly disposed of.
