Settlement Agreement dated 9th October, 2024 has been received from the Delhi High Court Mediation and Conciliation Centre. 2.
The present suit has been filed seeking permanent injunction restraining infringement of plaintiffs' registered Patent no. 262968 titled 'INHIBITORS OF BRUTON'S TYROSINE KINASE', damages, rendition of accounts and delivery up, etc. against the defendant for promotion and commercial dealing in an Ibrutinib product, under the brand name 'IBRUKEM'.

An interim injunction was passed in favour of the plaintiffs vide order dated 21st December, 2023, restraining the defendant from manufacturing and marketing Ibrutinib.

2024, where the parties have successfully negotiated a settlement and a Settlement Agreement dated 9th October, 2024, has been signed between the parties.

Today, learned counsel appearing for the parties jointly submit that the suit be decreed in terms of the settlement between the parties. 6.
This Court has perused the terms of the settlement and finds the same to be lawful.

The parties are held bound by the terms of the settlement. 8.
Accordingly, the suit is decreed in favour of the plaintiffs and against the defendants in terms of Para 55 (a) of the plaint and Settlement Agreement between the parties, which shall form part of the decree. 9.
In view of the fact that the parties have arrived at settlement, the Registry of this Court is directed to issue a certificate of Refund of Full Court Fees in favour of the plaintiffs.

Decree sheet be drawn up.

The present suit, along with the pending applications, accordingly stands disposed of.
