BAIL APPLN. 2168/2019 The present bail application has been filed on behalf of the petitioner under section 438 Cr.P.C. for grant of anticipatory bail. Learned counsel for the petitioner states that the petitioner/Jaiveer was only seen at the spot but no role has been assigned to him. Learned APP for the State submits that name of the petitioner has appeared in the statements of witnesses. However, the statements do not show active involvement of the petitioner in the incident. Learned APP, however, states that as per the CCTV footage, the petitioner is seen armed with a danda, but investigation is still in progress.

Learned counsel for the petitioner submits that the petitioner is ready to join the investigation as and when required. Heard.

Considering the submissions as made above and the fact that the petitioner is not seen in the CCTV footage giving danda blows to anyone and is only seen standing alongwith a danda like weapon. It is hereby ordered that in case of his arrest, he be released on bail on his furnishing a personal bond in the sum of Rs. 10,000/- with one surety of the like amount to the satisfaction of the IO/SHO.

It is also made clear that if during the investigation some more incriminating evidence appears showing his active involvement and his custodial investigation is required for recovery of weapon if any, he will be given seven days notice before his arrest.

IO states that the petitioner should join the investigation on 31.08.2019 at 4:00 PM. The petitioner is directed to join the investigation as and when required by the Investigating Agency. A copy of this order be given dasti to learned counsel for the parties under the signature of the Court Master.
