Petitioner impugns order dated 13.05.2019 whereby leave to defend application of the petitioner was dismissed and an eviction order passed.

Respondent had filed the subject eviction petition seeking eviction of the petitioner from Shop No. 4 in property bearing No. E31, Milap Nagar, Uttam Nagar, New Delhi on the ground of bonafide necessity under section 14(1) (e) of the Delhi Rent Control Act, 1958. 3.

Parties were referred to mediation. Settlement agreement dated 15.11.2019 has been executed between the parties. As per the settlement, the petitioner had agreed to hand over the peaceful vacant possession of the tenanted premises to the respondent on or before 30.11.2019.

Learned counsel for the parties under instructions from the parties that are present in court, inform that the peaceful vacant possession of the tenanted premises was handed over on 06.12.2019. 5.

Learned counsel for the parties further submit that all disputes between the parties have been fully and finally settled and now there are no claims or dues pending against each other. 6.

In view of the above, learned counsel for the petitioner seeks leave to withdraw the petition.
