Learned counsel for the petitioners, on instructions, states that neither any charge-sheet has been filed against petitioner Nos.1 and 2 nor have they be summoned. As regards petitioner No.3, it is stated that she has not been named in the chargesheet.

Learned APP confirms that petitioner Nos.1 and 2 have not been charge-sheeted. He however, states that supplementary challan qua petitioner No.3 is likely to be filed.

At this stage, learned counsel for the petitioners seeks leave to withdraw the present instant petition with liberty to approach the Court, as and when charge-sheet is filed against petitioner No.3. 4.

Leave and liberty, as prayed for, are granted. In view of the same, the petition alongwith pending application is dismissed as withdrawn.
