O R D E R

This petition has been filed seeking wilful disobedience of judgment dated 25th March 2025, passed in Writ Petition (C) No. 6694/2024, where the following directions have been passed:

"16. However, keeping in view that the reference is pending before the Larger Bench, we direct that the seniority list, which shall be redrawn by the respondents pursuant to our judgment, shall be subject to the outcome of the reference.

17. The respondents shall rework the Seniority List and publish the revised list after considering objections, if any, filed to a draft seniority list, within six months from today."

It is stated by Mr. Harpreet Singh, counsel for petitioner, that although the period of six months granted to respondent has not yet expired, in the meantime, respondent has proceeded to promote certain persons in complete The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. violation of Courts' orders. He points out to paragraph 13 of the said order which is extracted as under:

"13. Applying the above principle, retrospective seniority even before the personnel is born in the Cadre, cannot be granted. The impugned seniority list insofar as it determined seniority m violation of the said principal, is liable to be quashed."

In the opinion of this Court, any separate action, by respondent, regarding certain promotions give rise to a fresh cause of action. Petitioner is always at liberty to approach the writ court in this regard, and this matter cannot be considered by this Court in its contempt jurisdiction. 4.

Counsel for respondents states that they will comply with paragraph 17, extracted above.

It is further pointed out by him that review petition has been filed by the affected persons, challenging the order of 25th March 2025, in which notice has been issued and the next date is 7th July 2025. 6.

Petition is disposed of in above terms with liberty to the petitioner, along with the pending application.
