The present petition under Section 482 of the CrPC (Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ) seeks following prayers:- "In view of the above, it is therefore most respectfully prayed that this Hon'ble Court may graciously be pleased to quash the Criminal Complaint filed by Mr.

Harinder Sikka, and the Notice Notice No.

814/Reader/ACP/SEC-V/EOVV Dt.22-5-25 which is issued ·by the Respondent on the said Criminal Complaint of Mr. Harinder Sikka, alleging offences of Cheating, Forgery etc., which allegations were already part of the Arbitration Case No. 16 of 2016 culminating into Award dt.21-11-2019 whereby after evidence in Trial the Competent Forum has dismissed the said allegations of Mr. Harinder Sikka, who is now repeating the same allegations after the filing of the Execution Petition No. 29 /202 for Execution of the Award dt.21-11-2019, and in the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. said facts & circumstances, it is in the interests of justice that the petitioner is protected from any coercive action being taken on such allegations made by Mr. Harinder Sikka ;

In the alternative in view of the above facts and circumstances, this Hon'ble Court may kindly be pleased direct the respondents to not take any coercive action against the petitioner, and/ or direct the respondents by a suitable order or direction, mandating them to serve at least 72 hours notice to the petitioner so as to enable the petitioner to approach this Hon'ble Court and seek appropriate reliefs, in the interests of justice; Any other Order (s) or Relief (s) as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case, and in the interests of justice and fairness;"

Learned APP for the State, who appears on advance notice, on instructions from the Investigating Officer, submits in pursuance of the impugned notice dated 25.05.2025, the petitioner has joined the investigation and has given necessary documents.

The present petition has been filed in pursuance of the impugned notice which has already been complied with by the petitioner. It is further noted that no FIR yet has been registered and the matter is under enquiry. 6.

In view of the above, the present petition is not maintainable at this stage and the same is dismissed and disposed of accordingly. 7.
