IN THE HIGH COURT OF DELHI AT NEW DELHI

+ CRL.M.C. 632/2018 ISLAM & ORS ..... Petitioners Through Mr. Durgesh Gupta, Advocate.

versus STATE & ANR ..... Respondents Through Mr. Akshai Malik, APP for the State.

CORAM:

HON'BLE MR. JUSTICE SANJEEV SACHDEVA

O R D E R

% 09.03.2018 Crl.M.A. 4537/2018 By this application, the petitioners seek impleadment of respondent Nos.3 to 5, who are stated to have received simple injuries in the subject FIR.

In view of the above, the application is allowed. Respondents Nos. 3 to 5 are impleaded as parties. Amended memo of parties is taken on record.

CRL.M.C. 632/2018 1.

The petitioners seek quashing of FIR No.530/2014 under Sections 324/326/356/379/452/34 IPC; Police Station Bhajan Pura based on a settlement.

2.

It is contended that the petitioners and respondent Nos.2 to 5 are neighbours and belong to the same community/religion. It is further contended that the parties have settled their disputes with the CRL.M.C. 632/2018

intervention of locals, elders and respectable members of the society to restore peace and harmony in their locality. 3.

Respondent Nos.2 to 5 are present in person and are identified by the Investigating Officer. They submit that they have settled their disputes with the petitioners with the intervention of the local Masjid Committee, elders and respectable members of the society and they do not wish to press any charges against the petitioners. They have also filed their affidavits of 'no objection'. 4.

In view of the fact that the parties have settled their disputes with a view to restore peace and harmony, the parties being neighbours and the fact that the respondent Nos.2 to 5 do not wish to press any charges against the petitioner, in my view, no fruitful purpose would be served in continuing with the criminal proceedings as there is a slim likelihood of conviction. Further, in view of the fact that the parties have settled their disputes, it would be expedient and in the interest of justice, to quash the subject FIR as well as the consequent proceedings arising there from.

5.

In view of the above, the subject FIR No.530/2014 under Sections 324/326/356/379/452/34 IPC; Police Station Bhajan Pura and the consequent proceedings emanating there from are quashed. 6.
