O R D E R

% 14.01.2016 Learned counsel for the decree holder submits that the judgement debtor No.1 has been served through publication. However, none has been appearing and the decree holder has not been able to locate any assets of the judgement debtor No.1, which could be attached and sold in execution of decree against judgement debtor No.1.

So far as judgement debtor No.2 is concerned, the decree stands set aside and the suit restored.

In these circumstances, the petition is disposed of with liberty to the decree holder to file afresh within the period of limitation, if the decree holder is able to locate the assets of the judgement debtor company. VIPIN SANGHI, J JANUARY 14, 2016 B.S. Rohella
