This is a bail application filed by the petitioner under Section 483 of the Bharatiya Nagarik Suraksha Sanhita 2023 seeking extension of interim bail for a period of 45 days in FIR No. 482/2014 dated 15.05.2014 for the offence punishable under Section 302 of the Indian Penal Code, 1860 registered at Police Station Mukherjee Nagar, Delhi.

The learned counsel for the petitioner submits that vide Order dated 15.05.2025, this Court had granted interim bail to the petitioner for a period of two weeks to undergo surgery with respect to the left lower limb Varicose Veins.

The learned counsel further submits that the petitioner had undergone said surgery on 21.05.2025 and has been advised rest for a period of 20 days for complete recovery. He further submits that his right leg is also to be operated with respect to the Varicose Veins. In support of his submission, he has brought to the notice of this Court a medical certificate dated 21.05.2025, wherein it has been advised to the petitioner to undergo surgery of his right leg as well. 6.
The learned APP for the State opposes the present application by submitting that vide Order dated 15.05.2025, on the day when the first application seeking interim bail was listed, there was no whisper of presence of Varicose Veins in his right leg. He further submits that, at this stage, there is no ground to extend the bail. 7.
In view of the above, as well as, from the perusal of the medical certificate dated 21.05.2025, the Doctor has just mentioned that his right leg is also to be operated. Furthermore, it has not been mentioned as to what procedure is to be followed and on which date. 8.
In these circumstances, the petitioner to surrender before the Jail Superintendent concerned, in compliance of the Order dated 15.05.2025.

At this stage, the learned counsel for the petitioner submits that he may be granted liberty to file a fresh application seeking interim bail with respect to surgery of the right leg of the petitioner. Accordingly, the present application stands disposed of with the liberty as prayed for, in accordance with law.
