% 05.08.2016 By the present petition the petitioner seeks anticipatory bail in case FIR No.2535/2015 under Sections 186/353/506/34 IPC registered at PS Mehrauli on the complaint of Brahm Singh, Assistant Engineer DDA. The allegations in the FIR are that when the complainant was getting the boundary wall of a DDA plot raised, Shakti Singh along with the petitioner did not permit the complainant to raise the wall, created a ruckus and manhandling. The allegation of slapping the complainant is against Shakti Singh.

As per the Status report a video recording of the incident has also been supplied to the investigating agency and the only role attributed to the petitioner is of creating obstruction in the Government work. As per the video recording the petitioner is not seen manhandling or assaulting the complainant. The petitioner has already joined the investigation. Considering the facts and circumstances of the case it is directed that in the event of arrest the petitioner be released on bail on his furnishing a personal bond in the sum of `50,000/- with two sureties of the like amount subject to the satisfaction of the Arresting Officer/ SHO concerned, further subject to the condition that the petitioner will not threaten the witnesses or cause impediment in the working of the complainant at the site, subject to orders of the civil court and that he will not leave the country without the prior permission of the Court concerned.
