Petitioner impugns order dated 19.07.2019 whereby the office of the Estate Officer has ordered the petitioner to pay damages for unauthorised occupation under Section 7(7) of The Public Premises (Eviction of Unauthorised Occupants) Act, 1971.

Learned counsel for the respondent who appears on advance notice submits that the said order is appealable to the Court of District Judge under Section 9.

Learned counsel for the petitioner seeks leave to withdraw the petition with liberty to file an appeal under the Public Premises Act. 4.

Petition is dismissed as withdrawn with liberty to the petitioner as prayed for, however, the issue of limitation, if arising, would be considered by the District Judge in accordance with law. All rights and contentions of the parties are reserved.
