The case arises out of FIR No. 104/2021 dated 26.03.2021 registered at Police Station Neb Sarai for an offence under Section 376 IPC. 2.

The Petitioner has approached this Court challenging an Order dated 16.07.2022 wherein charges under Section 354, 376, 376(2), 471, 506 IPC read with Section 6 of the POCSO Act have been framed against the Petitioner.

Ms. Richa Dhawan, learned APP for the State, submits that the Petitioner has already been convicted in the said FIR and vide Order dated 04.05.2024 and the Petitioner has been sentenced to undergo rigorous imprisonment for a period of 10 years for offence punishable under Section 376(2)(n) IPC with fine of Rs.25,000/- and in the event of failure to pay the said amount of fine, the Petitioner shall undergo simple imprisonment for a period of one year. been sentenced to undergo rigorous imprisonment for a period of two years with fine of Rs.5,000/- and in the event of failure to pay the fine, the Petitioner shall undergo simple imprisonment for a period of three months. Further, for offence under Section 506 IPC, the Petitioner has been sentenced to undergo rigorous imprisonment for a period of two years with fine of Rs.2,000/- and in the event of failure to pay the fine, the Petitioner shall undergo simple imprisonment for a period of three months. 4.

In view of the above, nothing survives in the matter. The petition is disposed of as infructuous along with pending application(s), if any.
