On account of a marital discord between the parties, the proceedings are pending before the learned Family Court. 2.

During its pendency, interim maintenance of Rs. 25,000/- per month was payable to the Petitioner herein (Wife of the Respondent). By interim order dated 17.10.2023, the Husband (Respondent herein) was directed to pay Rs. 15,000/- per month which was subsequently vacated by virtue of order dated 23.12.2024. It was clarified through the order that the Respondent (Husband/Appellant in MAT.APP.(F.C.) 304/2023) shall continue to remain liable to pay Rs. 25,000 per month.

The Petitioner submits that the aforesaid order has not been complied with and there is willful violation of the order dated 23.12.2024.

proceedings should not be initiated unless the court comes to conclusion that there is willful violation of the directions of the Court. The Order assessing interim maintenance can be executed by the Petitioner herein (Respondent in MAT.APP.(F.C.) 304/2023). 5.

In these circumstances, we are not inclined to continue with the contempt petition. The same is accordingly disposed of with liberty to the Petitioner to file application for its implementation. ANIL KSHETARPAL, J.
