% 14.07.2017 It is submitted that petitioners and respondent nos.2 and 3 have settled their disputes amicably; therefore, FIR No.139/2013 under Sections 186/323/324/332/353/34 IPC registered at Police Station Gandhi Nagar, may be quashed. A perusal of the present FIR shows that it was registered on the complaint of respondent no. 2 Bharat. It is pointed out that on the complaint of petitioner no. 1 Charan Singh, a cross FIR no. 140/2013 under Sections 308/324/34 IPC was registered at Police Station Gandhi Nagar against the

respondent nos. 2 and 3, namely, Bharat and Dinesh. In view of the compromise arrived at between the petitioners and respondent nos. 2 and 3, the said FIR has already been quashed by this Court vide order dated 8th February, 2016 passed in Crl. M.C. No. 523/2016. Respondent nos. 2 and 3 are present in Court along with their counsel and have been identified by SI Nishant, P.S. Gandhi Nagar. They admit that they have settled the matter with the petitioners of their own free will and without any undue force, pressure or coercion.

Respondent nos. 2 and 3 submit that they are not willing to pursue the FIR any further in view of the settlement arrived at between them and the petitioners.

Keeping in mind the settlement arrived at between the petitioners and respondent nos.2 and 3, inasmuch as a cross FIR registered against the respondent nos. 2 and 3 on the complaint of petitioner no. 1 has already been quashed, in the interest of justice, FIR No.139/2013 under Sections 186/323/324/332/353/34 IPC registered at Police Station Gandhi Nagar and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
