1. The short ground on which the Petitioner is seeking relief by way of this petition is that, as part of the tests to be undergone by him, for selection to the post of Constable/General Duty ('Ct./GD') in the Central Armed Police Forces ('CAPFs'), he could not complete the 5 km race, which was conducted on 13th August, 2019. The Petitioner states that one day earlier to the race, he fell seriously ill and that, therefore, he was not in a position to undertake the race.
2. Learned counsel for the Respondents, on instructions, informs the Court that there is no provision under which any relaxation can be granted in the matter of completion of the 5 km race, which took place on the appointed date. He refers to the terms and conditions governing the selection, which are part of the notice published by the Staff Selection Commission ('SSC') W.P.(C) 9545/2019 Page 1 of 2
for the Examination, 2018 for recruitment of Ct./GD in the CAPF.
3. The Court is constrained by the fact that the terms and conditions governing the selection, do not provide for any relaxation to a candidate who is unable, for some reasons, to undertake the 5 km race, on the appointed date.
4. The Court, therefore, is not in a position to grant any relief prayed for. The petition is accordingly dismissed. No costs. S. MURALIDHAR, J.
