% 09.05.2025 Mr. Ajay Kumar Jha, learned counsel appearing for the appellant submits that the parties had resolved the matter amicably out-of-court; and seeks leave to withdraw the present appeal. 2.

Mr. Aditya Jain, learned counsel for the respondent has joined the proceedings via video-conferencing; and confirms the submissions made on behalf of the appellant.

In view thereof, the appeal is disposed-of as withdrawn. 4.

Pending applications, if any, also stand disposed-of. 5.

Mr. Jha requests that since the matter has been resolved amicably outof-court, the entire court-fee may be refunded. 6.

In view of section 16-A(iii) of the Court Fees Act 1870, and considering the facts and circumstances of the case, and especially the fact that the appeal has not yet been heard, the Registry is directed to refund 50% of the court fee affixed on the appeal to the appellant RFA 738/2023 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
