Mr. Birbal states on instructions that emoluments which are being paid, are in consonance with their rules and in compliance of orders of this Court.

Ms. Sumita Hazarika, counsel for petitioner, however, states that her last drawn salary should have been considered at Rs.39,800/-, by accommodating all promotional benefits, that they would have received. 3.

Mr. Birbal states that the petitioner will not be entitled to promotional benefits as he was not in service at that point of time and has been granted only notional benefit by judgment of this Court. 4.

In any event, he has handed over a document which states that the PPO has been issued by the Pension Cell and is being granted with effect from June 2020, and has been considered by the higher authorities as well. 5.

He shall file reply affidavit, in this regard, with copy to the counsel for petitioner, within the next 8 weeks.

In the meantime, Mr. Birbal states that he will ensure that monthly pension, as sanctioned, is being paid regularly to the petitioner. 7.
