WP(C) No.917/2017 & 4165/2017 After hearing Mr. Chhibber and Mr. Bhardwaj, the writ petition is disposed of by directing the Director General, CISF, to treat the writ petition as a representation of the petitioner and take a reasoned decision thereon in accordance with law, in the light of the Standard Operative Procedure for Selection of CISF Personnel for security of UN / India Mission abroad and in particular, paragraph 1(g) of Appendix-"A" thereto, which provides that preference would be given to officers and men who have not done any deputation in UN / India Mission abroad earlier; and also in the light of the

judgment dated 15.10.2012 of a Division Bench of this Court in WP(C) No.6498/2012, Nishant Sankale v. Union of India & Ors., where the respondents took the stand that a candidate placed lower in the list who has not been on UN / India Mission abroad would be entitled to preference. A decision shall be taken as expeditiously as possible. Until such time as a reasoned decision is taken, no one shall be sent to Kathmandu as Deputy Commandant.

CM Appln. No.4165/2017 shall also stand disposed of. A copy of this order be given dasti under the signatures of the Court Master.
