CRL.M.C. 4390/2019 1.

Learned counsel for the petitioner submitted that the petitioner has challenged the impugned order dated 22.7.2019 before the Sessions Court, where the revision petition is listed for 30.9.2019.

The learned Trial Court, vide order dated 22.7.2019, had directed the petitioner to deposit the cost of Rs.2,00,000/- by 26.7.2019, however, at the request of the petitioner, the date has been extended to 3.9.2019.

Learned counsel for the petitioner submitted that his only prayer is that since the petitioner has challenged the impugned order dated 22.7.2019 and the same is fixed for hearing before

the learned Additional Sessions Judge on 30.9.2019, till then, no coercive steps be taken against the petitioner by the learned Magistrate and whatever order is passed by the learned Additional Sessions Judge, learned counsel for the petitioner submitted that the petitioner shall comply with the same in accordance with law.

The learned Additional Sessions Judge is directed to dispose of the matter positively on 30.9.2019 and meanwhile, no coercive action for the recovery of Rs.2,00,000/-be taken by the learned Magistrate till the disposal of the matter pending before the learned Additional Sessions Judge. 5.

In view of the aforesaid directions, learned counsel for the petitioner seeks permission to withdraw the petition. Accordingly, the petition is dismissed as withdrawn. CHANDER SHEKHAR, J SEPTEMBER 02, 2019 tp
