The petitioner has filed the present petition, inter alia, praying that the petitioner be released on bail in the event he is arrested in connection with FIR No.141/2017 under Section 406/409/420/120-B of the Indian Penal Code, 1860 (IPC) registered with PS Economic Offences Wing. 3.

The petitioner is a retired government servant and is aged seventyseven years. The allegation against the petitioner is that he had colluded with M/s Shubhkamna Buildwell Private Limited and its promoters in cheating several flat buyers who had booked flats in the project being developed by the said persons.

The petitioner is one of the persons who had formed the Government

and Public Sector Employees Welfare Housing Organization - which is a society of flat buyers - and had collected money from various members interested in purchasing the said flats. He had allegedly deposited the same with Shubhkamna Buildwell Private Limited and its promoters. 5.

At this stage, there is no allegation against the petitioner that he had appropriated any of the funds collected from the flat buyers. 6.

Ms Dhalla, learned APP appearing for the state, submits that the petitioner is required for investigation.

In the given facts, the present application is allowed and the petitioner is granted anticipatory bail subject to the petitioner furnishing a Personal Bond in the sum of ₹10,000/- and a surety bond of the like amount to the satisfaction of the trial court.

The petitioner shall ensure that he shall cooperate with the investigation agencies. He shall make himself available to the IO as and when called upon to do so. He shall also give his contact number to the IO and ensure that the same is operational at all times. The petitioner shall not leave this country without prior intimation to the IO. 8.

Needless to state that if any of the aforesaid conditions is violated, the anticipatory bail granted to the petitioner shall stand revoked. VIBHU BAKHRU, J SEPTEMBER 03, 2019 MK
