Paragraph no.5 of the preliminary objections filed by respondent no.2 is extracted as under:
"5. That the writ petition under reply is not maintainable for the reasons that the writ petition is pre-mature as it was filed on 17.09.2022 regarding the complaint dated 14.09.2022 without awaiting the action to be taken by the respondent no.2 on the second complaint. However, it is also submitted that the respondent no.2 considered the contents of the complaint dated 14.09.2022 and found that no actionable material was there in the complaint. Hence, the complaint dated 14.09.2022 was disposed of and information in this regard was given to the complainant, namely Mr. Rajendra Pradhan by a letter dated 10.04.2023. True copy of the letter dated 10.04.2023 given by the Respondent No.2 to the complainant shri Rajendra Pradhan is filed herewith as Annexure-R2/1." 2.
It is thus seen that the complaint of the petitioner has already been acted upon.
