The Petitioner has approached this Court for a direction to the Respondent to treat the Petitioner as qualified in the AIBE-XVII examination conducted by the Respondent on 05.02.2023. 2.

It is the case of the Petitioner that the passing percentage for the said examination was 40% and he had secured 41% and he should be declared to have passed the said examination.

Per contra, the case of the Bar Council of India is that qualifying percentage for the AIBE-XVII was 45%. On the last date of hearing, learned Counsel for the Petitioner had handed over a notification regarding the centre of the examination along a sheet which indicates that the minimum passing percentage for the general category was 40% and 35% for SC/ST/PWD categories.

On taking instructions, learned Counsel for the Bar Council of India states that the sheet provided with the notification is not part of the notification and the passing percentage is 45% and not 40%. The submission is taken on record.

In view of the assertion of the Bar Council of India that the passing percentage is 45% and not 40% for examination conducted by the Bar Council of India on 05.02.2023, this Court is not inclined to entertain the instant writ petition.

The writ petition is dismissed along with pending application(s), if any.
