Petitioner impugns order dated 22.04.2019 whereby eviction petition filed by the petitioner under Section 14(1) (b) has been dismissed.

Learned counsel for the petitioner seeks leave to withdraw the petition with liberty to file an appeal.

The petition is accordingly dismissed as withdrawn with liberty as prayed for.

However, it is clarified that the issue with regard to the limitation would be considered by the appellate court in accordance with law.
