setting aside order dated 31.08.2021, whereby all the three petitioners were released on anticipatory bail.

Learned counsel for the petitioner submits that applications under Section 439(2) Cr.P.C. have been preferred, since after the grant of anticipatory bail vide order dated 31.08.2021, threats were received by the petitioner. It is further submitted that further condition be imposed that the respondents shall not visit the area of 1 km. in the vicinity of residence of petitioner.

Learned counsel for the respondents submits that as per the report of prosecution, no such alleged threat could be corroborated and nothing adverse was found against the respondents. He further submits that respondents shall abide by the additional condition, as proposed by learned counsel for the petitioners.

Admittedly, the petitioners are on anticipatory bail since 31.08.2021 and the trial has further progressed. No threat as alleged by petitioner could be confirmed in inquiry by prosecution. Statement of learned counsel for respondent no. 2 is taken on record, as per instructions, that the respondents shall not visit the area of 01 km in the vicinity of residence of petitioner and shall not influence the witnesses in any manner. The petitions are accordingly disposed of. Pending applications, if any, also stand disposed of. A copy of this order be kept in connected petitions.
