By way of the present petition, the petitioner is seeking the following reliefs:

"a. quash the Summoning Order dated 11.10.2021 passed by Sh. Ravindra Kumar Pandey, Ld. Additional Chief Metropolitan Magistrate, Rouse A venue District Court Complex in Complaint case no.-15/2021 registered u/s 499, 500 and 501 of the Indian Penal Code, 1860 against the Petitioner and the consequential proceedings emanating therefrom; and/or, b. hold that the criminal complaint case no.-15/2021 registered u/s 499, 500 and 501 of the Indian Penal Code, 1860 against the Petitioner and the consequential proceedings emanating therefrom being illegal in view of non-compliance of provisions of section 199(2) and section 199(4) of the Code of Criminal Procedure, 1973;"

matter has been settled between the parties and respondent no.2 has no objection, in case the prayer made in the present petition is allowed. 3.

Considering the facts and circumstances of the case and also in view of the above statement of the learned counsel appearing for respondent no. 2, the impugned summoning order dated 11.10.2021, passed by the learned Trial Court is quashed.

With these directions, the petition stands disposed of. Pending application, if any, also stands disposed of. 5.
