The instant application under Section 12 of the Contempt of Courts Act, 1971 has been filed on behalf of applicant/petitioner seeking the following reliefs:- "A. Initiate contempt proceedings against the Assistant Collector Gr-I, Sub-Division Chankyapuri, New Delhi District and Assistant Collector Gr-II, Sub-Division Chankyapuri, New Delhi District, i.e. the Respondent No. 1, for willfully and deliberately disobeying the Order dated 13.09.2023 passed by this Hon'ble Court in the captioned Petition, AND/OR B. Pass any other order(s) as may be deemed fit and proper in the facts and circumstances of the case and in the interest of justice by this Hon'ble Court."

The instant application has been filed for initiation of contempt proceedings for alleged non-action on part of the respondent no. 1. 3.

The law regarding initiation of contempt proceedings is clear where the provisions as enshrined under the Contempt of Courts Act, 1971 ('the Act' hereinafter) needs to be invoked and the contempt proceedings can only be initiated thereafter.

In light of non-conformity with the procedure prescribed under law , this Court does not find any cogent reason to allow the instant application as the same has not been filed as per the mandate of the Act. 5.

In light of the same, the instant application is dismissed. W.P.(C) 12032/2023, CM APPL. 47182/2023 (Stay) & CM APPL. 48741/2023 (Direction) Learned counsel appearing on behalf of petitioner submitted that the instant petition may be dismissed as rendered infructuous as nothing survives in the present petition for further adjudication. Learned counsel appearing on behalf of respondents has no objection to the same.

In view of the above, the instant petition alongwith pending applications, stand dismissed as rendered infructuous.
