Learned counsel for the respondent has handed over two cheques bearing No.988121 dated November 15, 2016 and No.988122 dated December 15, 2016 drawn on The Nainital Bank Ltd. in the sum of ₹40,000/- each (total amounting to ₹80,000/-) to learned counsel for the appellant today in the Court with the assurance and undertaking that the same shall be encashed on presentation. Photocopy of the cheques have also been placed on record.

Learned counsel for the appellant, on the assurance given by learned counsel for the respondent, submits that he may be permitted to withdraw the instant appeal with liberty to get it revived in case the cheques are not enchased on presentation.

Accordingly, the appeal is dismissed as withdrawn granting the liberty as prayed for.
