Bail Application under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed on behalf of the Applicant for grant of Anticipatory Bail in FIR No. 0218/2025 registered under Sections 115(2)/126(2)/351(2)/110/3(5) BNS at P.S. Jyoti Nagar. 2.

The case of the Prosecution is that as per the FIR dated 29.04.2025, on 27.04.2025, while the Complainant alongwith his friend Rishabh was going on the motorcycle, who got off the motorcycle in front of MIG Flat Kuda Ghar, Gate No. 2. Thereafter, the Complainant continued going on his motorcycle and was stopped by two boys who were on a bike and two boys who were on a scooter. They enquired him of Rishabh and on their asking, he gave them mobile number of Rishabh. Thereafter, they stopped him and gave him beatings. One of them picked up a brick and hit him on the head. and ran away. The name of those boys, as disclosed by Rishabh, was Vivek and Kartik who live in Meet Nagar and New Modern Shahdara. 3.

The FIR further stated that he was unable to give a statement on 27.04.2025 due to severe pain and that legal action be taken against the Accused persons.

According to the Police, the search was made for eye-witnesses and CCTV cameras were checked, but no eye-witness was found. 5.

The learned Sessions Judge while hearing the Anticipatory Bail Application, directed the Applicant to join the investigations but he failed to do so. However, co-accused had joined the investigations and disclosed the name of the further co-accused, namely, Prince @ Neeraj Rana to whom Notice has already been served. The Anticipatory Bail Application of Applicant was dismissed on 14.05.2025.

Status Report filed on behalf of the State, is taken on record. As per the Status Report, after the interim protection by this Court, the Applicant has joined investigations. The co-accused Vivek has not yet been arrested and has been bound down in the present case.

From the FIR, it is not very clear if the incident took place on 24.04.2025. The Police was given information on 27.04.2025 on which date, the Complainant was unable to give a statement because of the pain from the injuries sustained by him. The statement has been recorded only on 29.04.2025 when the FIR has been registered.

Considering the nature of allegations and the totality of circumstances, the Applicant is admitted to Anticipatory Bail by the Investigating Officer/Arresting Officer, subject to the following conditions:- The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

(i) The Applicant shall furnish a personal bond in the sum of Rs.25,000/- with one Surety in the like amount to the satisfaction of the Investigating Officer/Arresting Officer.

(ii) The Applicant shall join the investigations, as and when called by the Investigating Officer and shall co-operate during the investigations.

(iii) The Applicant shall furnish his cell phone number to the Investigating Officer on which he may be contacted at any time and shall ensure that the number is kept active and switched-on at all times. (iv) The Applicant shall not contact, nor visit, nor offer any inducement, threat or promise to any of the prosecution witnesses or other persons acquainted with the facts of case. (v) The Applicant shall not tamper with evidence nor otherwise indulge in any act or omission that is unlawful or that would prejudice the proceedings in the pending trial.

The Bail Applicant stands disposed of in the above terms. 11.
