O R D E R

The present writ petition filed under Article 226 of the Constitution of India read with Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (Corresponding to Section 482 of Code of Criminal Procedure, 1973) seeks the following prayers:

"i) Directing the Respondent/Delhi Police to file on record the Inquire Report submitted by Inquiry Officer/ ACP-PG Cell with respect to the torture and Custodial violence committed on Petitioners on 12.06.2023 & 13.06.2023, and to furnish a copy of the same to the petitioners;

ii) Directing the Disciplinary/Competent Authority of Delhi Police to Initiate disciplinary actions/proceedings against Police Officials found involved in the torture and Custodial violence committed on Petitioners as per said inquiry report submitted by Inquiry Officer/ACP-PG Cell;

iii) Directing the Delhi Police to initiate the appropriate legal action for criminal offences committed by the police officials and private persons found involved in the torture and Custodial violence committed on Petitioners as per the inquiry report submitted by The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. iv) Awarding the suitable compensation to the Petitioners for the physical and mental trauma, loss of reputation, and the violation of their fundamental rights;"

Pursuant to the directions issued by this Court vide order dated 19th September, 2024, the Respondents have filed a detailed Compliance Report. Based on the inquiry conducted, the State has concluded that the allegations made by the Petitioners were unsubstantiated, and therefore no further action has been taken.

Mr. Vivek Sood, senior counsel appearing for the Petitioners, however, contends that the conclusions drawn in the inquiry report are erroneous. He submits that the Petitioners remain dissatisfied with the manner in which the inquiry was conducted, and therefore, the Court must grant the reliefs as prayed for.

The Court has carefully examined the inquiry report and is of the considered opinion that a thorough and comprehensive inquiry was conducted by the concerned authorities. As the report concludes that no culpability has been established warranting further action, this Court finds no justification to issue any further directions. 5.

However, it is clarified, that if the Petitioners are aggrieved by the findings of the inquiry report, or seek compensation or any other relief, they are at liberty to pursue appropriate remedies in accordance with law. 6.

With the above observations, the present petition, along with pending application(s), stands disposed of.
