The learned counsel appearing on behalf of the applicant concedes that the matter is now listed for recording defence evidence before the learned Trial Court and the next date of hearing before the learned Trial Court is 23.09.2025.

Considering the overall facts and circumstances of the case and as submitted that the prosecution evidence has been concluded and the prosecutrix has supported the prosecution case and the DNA report also supports the prosecution, the learned counsel for the applicant seeks permission to withdraw the present bail application. 3.

Accordingly, the present bail application stands dismissed as withdrawn, at this stage.

It is directed that the learned Trial Court will conclude the trial within three months from the date fixed before it, provided that the learned defence counsel will not seek adjournment before the learned Trial Court.
