Present petition was instituted on the basis of the letter dated 21st March, 2022 written by Mr. Ram Avtar stating that he had served more than 30 years in Delhi Transport Corporation (D.T.C.) and retired as Traffic Inspector (ATI). He further states that D.T.C. was providing medical facilities only to the serving employees under Delhi Government Employees Health Scheme. However, no medical facility was provided to the retired employees/pensioners.

Today, learned counsel for D.T.C. has drawn this Court's attention to the letter dated 14th February, 2024 written by Deputy Commissioner, DTC Secretariat, Government of National Capital Territory of Delhi ('GNCTD') to the Managing Director, DTC. The said letter reads as under: "To The Managing Director, Delhi Transport Corporation, I.P. Estate Headquarter, Delhi-110002 Subject:- W.P. (C) 13686/2022 & CM APPL. 60712/2023 titled "Court on its own motion Vrs. DTC & Ors.
Madam, 1.
In the month of September, 2023, Transport Department, Government of NCT of Delhi filed status report in the WP (C) No. 13686/2022. However, the Hon'ble High Court vide its order dated 23rd November, 2023 pleased to accept the application of DTC Pensioners Welfare Forum in the WP (C) No. 13686/2022 as CM Appl 60712/2023 and directed respondents to file reply affidavits within four weeks upon receipt of copy of the application.

The earlier decision of Finance Department on extension of existing DTC specialised medical scheme for retired employees of DTC (Pensioners and NonPensioners, their dependents and eligible dependents of deceased employees) as welfare measures was communicated DTC vide letter dated 24.05.2023. On receipt of the application of DTC Pensioners Welfare Forum, the concern matter raised was also submitted to Finance Department of Government of NCT of Delhi by Transport Department. The Finance Department, Government of NCT of Delhi retreated its earlier stand and also stated that a detailed study is required for understanding the financial implications covering all such employees of autonomous bodies 3.

Since GNCTD is undertaking a detailed study for understanding the financial implications covering all employees of autonomous bodies, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
including DTC, this Court is of the view that it would not be appropriate to proceed ahead with the matter. Accordingly, the present writ petition and pending application are closed.
